LITTLE WHALE COVE HOMEOWNERS' ASSOCIATION

RULES FOR RENTING AND LEASING

 

PURPOSE: 

To protect Little Whale Cove and assure the best possible community environment from a physical, emotional, and financial standpoint these rules are established.  These Rules apply to and must be observed by all owners, guests, family members, invitees, lessees, and renters in Little Whale Cove. 

 

AUTHORITY:

The following Rules apply to and must be observed by all owners, guests, family members, invitees, lessees, and renters in Little Whale Cove. The Rules are adopted under authority of LWC CC&R's (6.4 Project Rules, 8.5 Default in Payment of Assessments & Fines, and 3.3.14 Government Regulation), and will be strictly enforced by the Board of Directors as per the Revised Enforcement Procedures adopted by the Board on October 4, 2002.

 

 IT IS RESOLVED:

1.       All homeowners who rent or lease their properties are asked to join the Multifamily Housing Council of Oregon at 2765 19th Street SE, Salem, OR. 97303.  Call 1 ‑800‑378‑7129, Extension 3, to request a Public Records Search for long‑term renters or lessees.

 

  1. Owners should note that Little Whale Cove is zoned R4 (Residential for Planned Communities) in the City of Depoe Bay.  Ordinance # 234 in Depoe Bay prohibits transient or short term rentals (defined as rentals less than 30 calendar days).

 

  1. OWNERS AND RENTERS RULES SHOULD BE PLACED IN A PROMINENT PLACE IN A RENTED OR LEASED UNIT.

 

  1. All rentals and leases shall be registered with the manager to facilitate management's control of the Development and compliance with the CC&R's and all policies, rules and regulations promulgated there under.
  2. Registration shall include the following:
    1. Owners shall obtain an approved application form, completed by the prospective renter, and file it with the manager. Forms are available at the LWC Office.
    2. Owners must secure acknowledgment from the renter or lessees that renter or lessee has received the Rules for Renting and Leasing and Rules for Owners.
    3. Owners shall be responsible for their renters' and lessees' failure to comply with all Little Whale Cove CC&R's, Rules, Regulations and policies the same as if the owners themselves failed to comply.
